Terms of Service
Effective April 2, 2026. We may update these documents from time to time; we will revise the effective date above and, where appropriate, provide additional notice (for example by email or a notice in the dashboard). If you continue to use the Service after changes take effect, you agree to the revised terms or policy. For questions, use Contact.
1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Formsig (“Formsig,” “we,” “us,” or “our”) governing your access to and use of the Formsig website, dashboard, APIs, hosted form endpoints, and related services (collectively, the “Service”). By registering for an account, clicking to accept these Terms, or using the Service in any way, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
If you do not agree to these Terms, you must not access or use the Service. We may refuse service, close accounts, or limit use to anyone at any time for any reason permitted by law or these Terms.
2. Eligibility
You must be at least the age of majority in your jurisdiction (typically eighteen (18) years old in the United States) to create an account. By using the Service, you represent that you meet this requirement and that all registration information you submit is truthful and current.
3. Description of the Service
Formsig provides hosted infrastructure that lets you create configurable HTTP endpoints (for example, URLs of the form /f/<form-id>) that accept submissions from HTML forms, programmatic clients, or other integrations you configure. Depending on your plan and settings, the Service may store submission payloads (including structured fields and, where enabled, files or file metadata), send email notifications to addresses you verify, send optional automated messages to people who submit your forms (where you enable that feature), deliver outbound webhooks to URLs you configure, and expose a web dashboard to manage forms, review submissions, export data, and configure account and billing settings.
The Service is offered on a subscription or usage-limited basis as described on our pricing page and in your account. Features, limits (including submission counts, storage, notification quotas, and webhook availability), and integrations may vary by plan. We do not guarantee that any particular third-party tool (for example Zapier, Make, or a custom stack) will interoperate with webhooks or email without additional configuration on your side.
We may add, change, or remove features, impose new technical or fair-use limits, or discontinue parts of the Service. Where a change materially reduces functionality you already pay for, we will use reasonable efforts to provide advance notice (for example via email or an in-dashboard message), except where we must make an immediate change for security, legal, or operational reasons.
4. Account registration and security
You must create an account to use most features of the Service. You agree to provide accurate, complete information and to keep your account information updated. You are responsible for safeguarding passwords, API tokens, form endpoint identifiers, webhook secrets, and any other credentials. You are responsible for all activity that occurs under your account except where caused by our gross negligence or willful misconduct.
You must notify us promptly through Contact if you suspect unauthorized access to your account. We may require password resets, multi-factor authentication, or other steps where we believe they are necessary to protect the Service or other users.
5. Customer responsibilities and compliance
You are solely responsible for your websites, applications, marketing materials, and any forms or fields you deploy. You must comply with all laws and regulations that apply to you, including without limitation privacy, data protection, consumer protection, anti-spam, employment, and sector-specific laws (for example HIPAA or financial regulations) where relevant. You must not use the Service to collect categories of data or engage in practices that would require protections we do not provide unless you have obtained any required agreements or configurations from us in writing.
Where applicable law requires you to provide notice, obtain consent, honor opt-outs, maintain records, or respond to data subject requests for information collected through your forms, you are responsible for doing so. Formsig processes submission data to provide the Service to you; depending on jurisdiction and context, you may be an independent controller or a controller and we a processor for certain processing, regardless, you agree not to instruct us to process data in violation of law.
You represent and warrant that you have all rights necessary to submit any content (including personal data) to the Service and to grant the licenses described in these Terms.
Email and notifications. You are responsible for ensuring that any email sent through the Service, including instant or digest notifications to addresses you select, and optional automated messages to people who submit your forms, complies with applicable anti-spam, direct marketing, and electronic communications laws (for example CAN-SPAM, CASL, or rules under the GDPR or ePrivacy where they apply). That includes honoring opt-outs where required, providing accurate routing and identification information, and maintaining any consent or disclosure records your use case requires. You must send messages only to recipients you are lawfully permitted to contact.
6. Acceptable use
You may use the Service only in compliance with these Terms and applicable law. Without limiting the foregoing, you agree not to:
- Use the Service for any unlawful purpose or to promote illegal activity.
- Violate or infringe the intellectual property, privacy, publicity, or other rights of any person.
- Transmit malware, exploits, or other harmful code; probe, scan, or test the vulnerability of our systems without authorization; or bypass or circumvent security or access controls.
- Overload, flood, or attack the Service or third parties (for example denial-of-service attacks, excessive automated requests beyond fair use, or attempts to exhaust quotas shared across customers).
- Send unsolicited commercial email in violation of law, or use the Service to harvest or scrape personal data without a lawful basis.
- Impersonate any person or entity, or misrepresent your affiliation.
- Use the Service to build a competing product by systematic extraction of our non-public interfaces, except as allowed by law.
- Access or attempt to access data, accounts, or endpoints that are not yours, except as explicitly permitted (for example submitting to your own public form endpoint).
- Resell or sublicense the Service without our prior written consent, except that you may use the Service to serve your own end users as part of your normal business.
We may investigate violations and cooperate with law enforcement. We may remove content, suspend or terminate accounts, block traffic, or take technical and legal action we deem appropriate, with or without notice, if we believe you have violated these Terms or created risk for us or others.
7. Customer content and license to Formsig
“Customer content” means all data, text, files, and other materials that you or your end users submit to the Service (including form submissions, uploads, and configuration data). As between you and Formsig, you retain ownership of your Customer content subject to the licenses below.
You grant Formsig a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, display (in your dashboard), back up, and otherwise use Customer content solely to provide, secure, improve, and support the Service, to comply with law, and to enforce these Terms. This license survives for a reasonable period after termination to allow backups to expire and legal obligations to be met.
You may provide suggestions, feedback, or ideas about the Service (“Feedback”). You grant Formsig a perpetual, irrevocable, worldwide, royalty-free license to use Feedback for any purpose without obligation to you.
8. Formsig intellectual property
The Service, including software, branding, documentation, and our website design, is owned by Formsig and its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except to the extent forbidden prohibitions are unenforceable under applicable law.
9. Third-party services
The Service integrates with or relies on third-party services and infrastructure, including but not limited to hosting and edge networks (for example Cloudflare), email delivery providers (for example Resend), and payment processors (for example Stripe). Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services except as required by law.

10. Fees, billing, and taxes
Paid plans, fees, and billing cycles are described at checkout and in your account. You authorize us and our payment partners to charge your chosen payment method for all applicable fees. Fees are stated exclusive of taxes unless we say otherwise; you are responsible for any sales, use, value-added, or similar taxes associated with your purchase, other than taxes based on our net income.
If payment fails, we may suspend paid features or your account after notice where practicable. Unless required by law or stated otherwise at purchase, fees are non-refundable. If you upgrade, downgrade, or cancel, charges and credits may be prorated or handled according to the policies of our payment provider and what we display at the time of change.
11. Term; suspension; termination
These Terms remain in effect until terminated. You may stop using the Service and, where the product allows, delete your account at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, created security or legal risk, or if we cease offering the Service in your region.
Upon termination, your right to access the Service ceases. We may delete Customer content after termination subject to our retention practices and backup cycles described in our Privacy Policy. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, governing law, and dispute-related terms) will survive.
12. Confidentiality
Each party may receive non-public information from the other (“Confidential Information”). The receiving party will use reasonable care to protect Confidential Information and use it only for the purpose of the Service, except as required by law. This obligation does not apply to information that is public, already known, independently developed, or rightfully received from a third party.
13. Indemnification
You will defend, indemnify, and hold harmless Formsig and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Customer content or your forms and how you collect data; (b) your violation of these Terms or applicable law; or (c) a dispute between you and your end users or third parties relating to your use of the Service. We may assume exclusive defense and control of any matter subject to indemnification, at your expense, and you will cooperate with our reasonable requests.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMSIG DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT SUBMISSIONS OR NOTIFICATIONS WILL BE DELIVERED WITHOUT DELAY OR LOSS.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FORMSIG’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FORMSIG FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF YOU HAD NO SUCH PAYMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMSIG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
16. Governing law; venue
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. You and Formsig consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, subject to mandatory consumer protections in your jurisdiction where they cannot be waived.
17. General
Entire agreement. These Terms and any policies referenced herein (including our Privacy Policy) constitute the entire agreement between you and Formsig regarding the Service and supersede prior agreements on the same subject.
Assignment. You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Severability; waiver. If any provision is held invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver.
Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
Export. You may not use the Service in violation of U.S. or other export control or sanctions laws.
Notices. We may send notices to the email associated with your account or post notices in the Service. You are responsible for keeping your email address current.
